Authentic / Notarized Power of Attorney for Abroad
* In addition to the fees (emoluments) for the reception of the authentic / notarized power of attorney intended for abroad, a registration fee (tax) of €25 is added.
Useful Information
1°) Powers of attorney intended for abroad, like all notarized powers of attorney, must be concluded in the presence of a notary. It is not possible to be represented during the conclusion of an authentic / notarized power of attorney intended for abroad.
2°) In some cases, the power of attorney intended for abroad does not necessarily need to be authentic and may simply require a signature certification (we recommend that you check with the foreign recipient of the power of attorney beforehand). To proceed with a signature certification: click here.
3°) Authentic / Notarized powers of attorney received by a French notary must be exclusively drafted in French, even when they are to be used abroad. Therefore, a translation (by a sworn translator) may be necessary after the conclusion of the authentic / notarized power of attorney.
4°) Persons wishing to conclude an authentic / notarized power of attorney received by a French notary must be fully fluent in French to ensure the validity of the authentic / notarized power of attorney. Consequently, non-French-speaking persons wishing to conclude an authentic / notarized power of attorney must be assisted during the signing appointment by a sworn translator accredited by the Court of Appeal.
5°) Authentic / Notarized powers of attorney for abroad can be concluded remotely (via videoconference), but in practice, most foreign recipients refuse this mode of authentication (we therefore recommend checking beforehand). In the case of a notarized power of attorney for abroad done remotely, additional reception fees will be charged.
6°) For principals (i.e., signers of the power of attorney) acting as the legal representative of a company, a certificate of authority must be issued in addition to the authentic / notarized power of attorney. For the list of supporting documents required and the reception fees for this certificate: click here.
